Tracy Morgan Suing Walmart Over Fatal Crash

Former "30 Rock" star Tracy Morgan is suing Walmart for the highway crash in early June that left him seriously injured and a fellow comedian dead.

The suit was filed in US District Court in New Jersey, and claims that Walmart was responsible for the incident and should've never allowed truck driver Kevin Roper to drive after being awake for over 24 hours before the crash.  On top of claiming Roper was too tired to drive, the suit says Roper commuted 700 miles from his home in Georgia to work in Delaware. 

“Walmart was careless and negligent in the ownership and operation of its motor vehicle, which caused Mr. Morgan to suffer severe personal injuries,” the complaint says.

“As a direct and proximate result of said collision, Mr. Morgan was caused to sustain severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation.”

Walmart released a statement saying it will fully cooperate with the ongoing investigation.  Roper, 35, has pleaded not guilty to death by auto and assault by auto charges.  Investigators say Roper was driving 65 mph in a 45 mph zone when his tractor trailer crashed into Morgan's limo bus.  The crash killed 62-year-old comedian James McNair and injured several others.

Morgan was seriously injured, suffering a broken leg, broken nose and broken ribs.  He's been released from a rehabilitation center and will continue outpatient therapy at home.
